ELECTRICAL BOXES & ALL UTILITY EQUIPMENT PROVIDED BY EDD HELMS MUST BE ACCESSIBLE AT ALL TIMES YET, MUST BE OUT OF VIEW OF THE PUBLIC. EXHIBITOR IS RESPONSIBLE FOR HIDING FROM UNSIGHTLY VIEW BY APPROPRIATE MEANS SUCH AS PLANTS, CABINETS, STORAGE ROOMS, ETC. 1. Orders must be received with payment prior to the published deadline date to receive the advance rate. Floor plans for island booths and any booth requiring electrical/water/drain/air distribution must accompany order and payment for the advance rate to apply. 2. Edd Helms reserves the right to correct orders figured incorrectly; including rate changes due to orders received after the discount deadline date and/or orders submitted without electrical/water/drain/air diagrams with required details (main panel location, booth orientation, dimensions & amount of power/utility service required for each location). 3. Rates listed include supplying electrical service (and all utility water/drain/air services) to one location on the floor at the draped back wall of all in-line and peninsula booths. Island booths and 208V services require labor and material charges. Floor plans must show a location for the main distribution box otherwise, Edd Helms will supply the main power (and main water/drain/air service) at a convenient location. Relocation of the service will be billed on a time & material basis. 4. Exhibitors with hardwall displays must arrange for power (and all utility services; including water/drain/air services) to be installed inside the booth or provide access. 5. Separate outlets must be ordered for each piece of equipment and/or where an electrical service is required. 500 watt minimum per location. 6. Rates quoted do not include labor or material charges for connecting equipment, electrical distribution or special wiring. Labor and material charges will apply for all distribution from the main power source to all other locations in any type of booth configuration and will be automatically applied to your invoice on a time and material basis. 7. Wall, column and permanent building utility outlets are not part of booth space and may not be used by exhibitors. 8. Labor rates are based upon current wage rates and are subject to change without notice. There is a minimum labor charge of (1) hour per man for installation work. Removal of this work will be billed at a minimum half hour per man or minimum of half the total time of installation and will be automatically applied to your invoice. 9. Unless otherwise directed, Edd Helms personnel are authorized to cut floor coverings to permit installation of services. 10. All material and equipment furnished by Edd Helms for this service order shall remain the property of Edd Helms and shall be removed ONLY by Edd Helms Electric at the close of the show. 11. Under NO CIRCUMSTANCES shall anyone other than Edd Helms personnel make electrical, water, drain or air service connections or install fixtures. 12. All equipment regardless of source of power, must comply with Federal, State, and local codes. Edd Helms Electric reserves the right to inspect all electrical, water, drain, air devises and connections to ensure compliance with all codes. Edd Helms Electric is required to refuse connections where the exhibitor wiring or equipment of any kind is not in accordance with local electrical codes & utility codes. Charges may be incurred for inspections. 13. Use of open clip sockets, latex or lamp cord wire duplex or triplex attachment plugs, or non-U.L. approved equipment is prohibited. 14. If your U.L. fixtures are not part of your booth, they MUST be installed by Edd Helms Electric. 15. All exhibitor's cords must be of 14 gauge, 3 wire grounded type. Two (2) wire extension cords are prohibited. All exposed non-current carrying metal parts of fixed equipment, which are liable to be energized, shall be grounded. 16. All electrical equipment must be properly tagged and wired with complete information as to type of current, voltage, phase, cycle, horsepower, etc., required for operation. 17. Labor charges, material charges, and additional power/water/drain/air usage; if incurred, will be charged to the credit card on file. Payment in full must be finalized during the event. There is no post show billing. Services may be interrupted if payment is not satisfied during the event. 18. Credit will not be given for electrical, water, drain, air service installed and not used. Cancellations received in writing by Edd Helms Electric 14 calendar days prior to the first day of event move-in are subject to a 25% cancellation fee. Overpayments; except sales tax, in amounts less than $50.00 will not be refunded unless specifically requested in writing. 19. Electrical power for lights and displays, water, drain, and air services will be turned on one half hour prior to show opening and turned off one half hour after show closing. 20. All claims or disputes regarding service orders must be settled at the show and submitted in writing to the show service desk. No adjustments will be made after the show closes. 21. Past due balances are subject to a 1.5% per month service charge starting 10 days after the invoice date. Returned checks and credit cards will incur a $25.00 service charge. 22. Exhibitor will pay Edd Helms its attorney fees or applicable agency fees in the event it becomes necessary to turn this matter over to an attorney for collection, or file a lien, or foreclosure, or otherwise. 23. Edd Helms is not responsible for any damage or loss of power beyond its control, including, but not limited to, losses due to utility company failure, permanent power distribution failure, power failure caused by vandalism, faulty exhibitor equipment or overloads caused by exhibitor. Exhibitor agrees to hold Edd Helms, its officers, directors, employees and agents harmless for such power loss. In no event shall Edd Helms be liable for any indirect or consequential damages (including without limitation lost profits) even if advised of the possibility of such damages, whether under theory of contract, tort (including negligence), products liability or otherwise. Exhibitor shall indemnify and hold harmless Edd Helms, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, fines, penalties or costs of whatsoever nature (including reasonable attorney's fees) arising out of or in any way connected with Exhibitor's actions or omissions under this agreement. 24. In the case of third party billing, any unpaid invoices revert to the party contracting for the exhibiting space. Any service charges or collection fees are the responsibility of the contract exhibitor. 25. An audit is completed at each show. Any exhibitor or party affiliated with exhibitor's display found to be using power//water/drain/air services not ordered will be charged the standard rate plus an additional 20% audit fee. SPECIAL PLUMBING (WATER/DRAIN/AIR) TERMS & CONDITIONS: 26. Standard connection size for water is a 3/4" garden hose connection. Drain line size is 1-1/4" open connection or 3/4" garden hose connection. Connections to all other sizes cannot be guaranteed. 27. Compressed air - We supply 1/4 NPT Female Coupler, please come ready to connect to 1/4. Connections to all other sizes cannot be guaranteed 28. There is a minimum charge of 1 hour for installation and minimum 1 hour for removal of any water/drain/air services. The minimum charge for fill & drain service is a minimum of 1 hour for installation and a minimum 1 hour for removal. Labor rates are based on actual times of service provided. 29. Service will be installed on the floor at the backwall of the booth (for in-line pipe & drape booths). In island booths, service will be brought to the one most convenient location at the discretion of Edd Helms unless a floorplan is furnished by the exhibitor showing the desired location(s). This does not include fees for connection equipment. 30. All utility outlets (water/drain/air) include up to 50 feet of accomplished distance. Use of additional footage or equipment will be charged at the prevailing labor and material rates. 31. A separate connection fee will be made for each piece of equipment using connected service, weather connected directly or otherwise. 32. All work performed within booth attaching lines to equipment will be charged on a time and material basis in addition to connection fees. 33. Service outlet size will be determined by the volume required. 34. All equipment using water must have inlet and outlet properly tagged. 35. EDD HELMS will not be responsible for sediment, color, or taste of water in water line. 36. EDD HELMS will not be responsible for moisture, oil, or water in air lines, loss of pressure or excessive pressure. Exhibitors must supply their own filters, air dryers, pressure regulators, or other equipment to handle moisture or water. 37. Water pressure may vary. No guarantee can be made of minimum or maximum pressures. If pressure is critical, Exhibitor should arrange to have a pressure regulator valve or pump installed. 38. Edd Helms must have a minimum of 30 days notice in order to consider being able to supply special equipment such as regulators, strainers, traps, etc. 39. Special equipment requiring company engineering or technicians for assembly, servicing, preparatory work and operation may be executed without EDD HELMS personnel. However, all service connections to such equipment must be made by EDD HELMS personnel only. 40. Exhibitor holds EDD HELMS ELECTRIC harmless for any and all losses of service beyond their control. 41. Commercial Use of Information Edd Helms Electric will not sell or share the Information with third parties for any commercial purposes without your consent and express agreement. Edd Helms Electric may, however, use the Information in order to share generic, collective, group, or other non-identifying information about the use of Edd Helms Electric’s products and services as part of commercial transactions with third parties to help Edd Helms Electric improve its products and services or for any other lawful purpose. Third-Party Service Providers Edd Helms Electric may use third-party service providers and vendors to assist Edd Helms Electric in providing its products and services to you and others, including, without limitation, services to host Edd Helms Electric’s Software Services, Storefronts, payment processes, and other services pursuant to the Agreement. Edd Helms Electric may also use third-party service providers and vendors to store Information and other data. Any such third parties would have access to your Information for the limited purpose of assisting, as reasonably necessary, Edd Helms Electric in providing Software Services and other services pursuant to the Agreement. Edd Helms Electric may disclose your Information as Edd Helms Electric reasonably believes is required by court order, governmental directive, or other law, to protect the rights of Edd Helms Electric, or as otherwise allowed pursuant to the Agreement or applicable law. Information Protection Edd Helms Electric will retain, protect, and process the Information and underlying or related data using commercially reasonable practices. Although Edd Helms Electric will undertake such efforts to preserve and protect the integrity of the Information, you acknowledge and agree that all security measures have potential risks. Customer Control of Collected Data You may decline to provide or submit Information to us, however, some of our Software Services, Storefronts, or other services may not be available to you if you choose not to provide or submit Information. You also have a right to access the Information that we hold (about you) upon reasonable written request. Updates to our Policy By entering into the Agreement or the Acknowledgment or by using our products or services, you consent to the collection and use of your Information by us consistent with this Policy and the Agreement. We may change this Policy from time to time, for any reason. Any such changes become effective when posted. To the extent that this Policy is inconsistent with applicable law, it is the intent of Edd Helms Electric to comply with applicable law. If there is any conflict between any provision of this Policy and applicable law, such applicable law shall prevail; provided, however, that any such conflicting provision in this Policy shall be curtailed and limited only to the extent necessary to bring it within the legal requirements and the remainder of this Policy shall not be affected thereby. </div>
